This is an appeal from order which has been preferred under Section 37 of the Arbitration and Conciliation Act, 1996, which is accompanied with the delay condonation application, preferred by the appellant, while putting a challenge to the impugned judgment dated 20.08.2016. It is reported that there is a delay of 394 days in preferring the present appeal from order.
Since the material rights between the parties is to be decided in the appeal from order under Section 37 of the Act, though it is being vehemently opposed by the respondent counsel by filing an objection to it.
Considering the grounds taken in the delay condonation application, the delay, which has chanced, in filing the appeal from order, since has been satisfactorily explained, the same would stand condoned.
Accordingly, the delay condonation application would stand disposed of.
Put up this appeal from order next week for hearing at an admission stage.
