This is an application under Section 482 of the Code of Criminal Procedure, 1973, to quash the order dated 17.06.2022, passed by Judicial Magistrate/IIIrd Additional Civil Judge (Junior Division), Dehradun, in Complaint Case No. 4099 of 2018, "Rakesh Tyagi Vs. M/s Jiya Palace and Others", under Section 138 of the Negotiable Instruments Act, 1881, whereby the application filed by the applicant - accused under Section 145 of the Indian Evidence Act, 1872 seeking to place on record certain documents for the purposes of cross-examination of the complainant, has been rejected.
Heard Mr. Piyush Garg, learned counsel for the applicant and Mr. Pratiroop Pandey, learned A.G.A for the State.
The learned counsel for the applicant - accused submitted that the said order is not legally sustainable, and, relied upon a judgment of this Court dated 18.05.2018, passed in Criminal Miscellaneous Application No. 796 of 2018, "Bharat Joshi Vs. Central Bureau of Investigation Dehradun and Another".
Issue notice to the respondent no.2. Steps to be taken within a week. List this case on 29.08.2022. Till the next date of listing, further proceedings of the said Complaint Case No. 4099 of 2018 are stayed.
