Heard Mr. Rajat Mittal, learned counsel for the applicant and Mrs. Shivangi Gangwar, learned Brief Holder for the State.
The learned counsel for the applicant submitted that in this matter criminal revision should be filed. Therefore, he requested to permit the applicant to withdraw this proposed appeal with liberty to file a criminal revision.
The learned counsel for the State has no objection.
The present proposed Criminal Appeal (No.238 of 2022), is dismissed as withdrawn by granting liberty to file criminal revision against the impugned judgment dated 14.06.2022, passed by the District and Sessions Judge, Tehri Garhwal in Criminal Appeal No.03 of 2022, "State vs. Namo Narayan Mishra alias Narayan Tiwari", in accordance with law.
At the request of the learned counsel for the applicant, the Registry is directed to return the certified copies of the judgments, to the applicant as per rules.
