The proposed Appeal along with an application to condone the delay, has been received from the Superintendant of District Jail Haridwar.
Mr. D.K. Sharma, learned Senior Advocate is appointed as Amicus Curiae to assist the Court.
Heard Mr. D.K. Sharma, learned Senior Advocate/Amicus Curiae for the appellant and Mrs. Lata Negi, learned Brief Holder for the State.
The learned counsel appearing for the State submitted that the State has no objection to the delay condonation application.
The appellant is in judicial custody.
In the facts and circumstances of the case, the delay of 1429 days' in filing the present Appeal is condoned.
The present Appeal has been filed against the judgment dated 23.05.2016, passed by the Special Judge, N.D.P.S. Act, Haridwar in Special Sessions Trial No. 27 of 2009, "State Vs. Sonu", whereby the appellant-Sonu has been convicted and sentenced to undergo rigorous imprisonment for a period of ten years along with a fine of `1,00,000/- for the offence under Section 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Summon the Lower Court Record. List this matter on 25.08.2022. The Registry is directed to provide the copies to the learned Senior Advocate.
