We have heard learned counsel for the petitioner. The only aspect, which in our view requires consideration is the imposition of the condition in Clause 10 of the conditions of technical bid, which provides that the Firm of the bidder should be registered in the State of Uttarakhand and the proprietor of the Firm should be a resident of Uttarakhand State.
Learned counsel for the petitioner has submitted that this condition is violative of Article 14 of the Constitution of India. He has also relied upon the judgment of the learned Single Judge of this Court in Writ Petition (M/S) No.3816 of 2019 decided on 27.07.2021 'Kanwaljeet Singh Batra vs. Uttarakhand State Warehousing Corporation & another' 2021 (2) U.D.,47.
