Mr. Navnish Negi, learned counsel for the petitioners.
Mr. J.S. Virk, learned Deputy Advocate General with Mr. P.S. Uniyal, learned Brief Holder for the State/respondent no. 1 and 2.
None is present for the respondent no. 3. Mr. J.S. Virk, learned Deputy Advocate General apprises the Court that State has served notice through Investigating Officer but none is appearing today.
Keeping in view of the ratio decided by the Hon'ble Supreme Court in the case of "Hitesh Verma Vs. State of Uttarakhand and another (2020) 10 SCC 710" especially, the observations made by the Hon'ble Supreme Court in Paragraphs 18 and 22 of the judgment and also the fact that the incident took place on 02.06.2022 and the FIR has been lodged against the petitioners on 08.06.2022 and also the fact that the FIR was lodged against the petitioners i.e. victim by wife of the petitioner no. 1 for the alleged commission for the offences under Section 323, 504 & 506 vide FIR No. 160 of 2022 P.S. Kotdwar, Haridwar. This Court is inclined to grant the protection to the petitioners.
List this matter on 22.08.2022. In the interregnum, Investigating Officer of the case may proceed wherein the petitioners shall cooperate to the investigation but no coercive action shall be taken against the petitioners till the next date. Urgent certified copy of this order be supplied to the learned counsel for the parties, as per Rules.
