The present criminal appeal has been filed

against the judgment dated 11.05.2022, passed by the Ist

Additional Sessions Judge, Kashipur, District Udham Singh

Nagar in Sessions Trial No.167 of 2016, "State vs. Angrej

Singh alias Babu", whereby the appellant has been

convicted and sentenced to undergo rigorous

imprisonment for a period of one year along with a fine of

Rs.2,000/- for the offence under Section 4/25 (1B) of the

Arms Act, 1959.

2. Heard Mr. Shariq Khurshid, learned counsel for

the appellant and Mr. S.T. Bharadwaj, learned Deputy

Advocate General for the State.

3. This Criminal Appeal is admitted.

4. The learned counsel for the appellant submitted

that the appellant has been falsely implicated in this

matter; nothing was recovered from his possession; the

alleged recovery was planted; the appellant has no

criminal history; the appellant was on bail during the trial

and the conditions of bail were neither misused nor

violated by him.

5. The learned counsel for the State opposed the

bail application, however, he fairly conceded that the

appellant was on bail during the trial and the conditions of

bail were neither misused nor violated by him.

6. Considering the facts and circumstances of the

case, this Court is inclined to grant bail to the appellant

Angrej Singh alias Babu, provided he submits a personal

bond and two reliable sureties of the same amount to the

satisfaction of the court concerned.
