This criminal revision is preferred against the judgment and order dated 24.09.2021 passed by Judge, Family Court, Haridwar in Case No.128 of 2021, "Smt. Alka Vs. Shashank Priyank.
It is submitted by learned counsel for the revisionist that as per the salary certificate dated 04.10.2021, the gross salary of the revisionist is Rs.15050/- per month while the concerned Court granted interim maintenance to the respondent @ Rs.18,000/- per month, which is, prima facie, illegal.
From the perusal of the impugned order, it is clear that the concerned Court presumed monthly income of the revisionist as Rs.50,000/, accordingly, awarded Rs.18,000/- per month as interim maintenance while as per the salary certificate (Annexure-4), the gross salary is Rs.15050/- per month.
Accordingly, the execution of the impugned order will remain kept in abeyance, provided the revisionist pays Rs.10,000/- per month to the respondent.
