This Special Appeal has been filed along with an application for grant of leave to file the Special Appeal against the judgment dated 15.12.2021, passed by the learned Single Judge in Writ Petition (M/S) No. 2653 of 2021, "Ravindra Kumar vs. State of Uttarakhand and Others", whereby, the learned Single Judge has disposed of the writ petition with a direction to the Secretary, Education, the respondent no. 1, to decide the representation of the respondent no. 6 Ravindra Kumar- the writ- petitioner.

2. Heard Mr. Parikshit Saini, the learned counsel for the proposed appellant, Mr. Anil Kumar Bisht, the learned Additional Chief Standing Counsel for the State and Mr. Rajendra Dobhal, the learned Senior Advocate assisted by Mr. I.P. Gairola, the learned counsel for the respondent no. 6.

3. Mr. Parikshit Saini, Advocate submitted that the respondent no. 6- writ- petitioner is guilty of concealment of material facts in his writ petition.

4. In the facts and circumstances of the case, leave is granted.

5. Mr. Rajendra Dobhal, the learned Senior Advocate/respondent no. 6-writ- petitioner requested time to get instructions from the respondent no. 6 and submitted that the impugned judgment may be stayed till the next date of listing.

6. The learned counsel appearing for the State and the learned counsel for the appellant have no objection.

7. Having heard the learned counsel for the parties and in the submissions of the learned counsel for both the parties, the effect and operation of the judgment dated 15.12.2021, passed by the learned Single Judge in Writ Petition (M/S) No. 2653 of 2021, "Ravindra Kumar vs. State of Uttarakhand and Others", is stayed.

8. At the request of learned counsel for both the parties, list on 04.03.2022.
