The petitioner to the present writ petition had contended that while the petitioner was working with the respondent Department, he has attained the age of superannuation as back as on 31.12.2019, but his certain dues, which he has produced for payment before the respondent has not been paid in relation to the period of services, which has been detailed by the petitioner in the writ petition, and particularly, also in the relief clause.
The petitioner contends that agitating his grievances, the petitioner has made a representation before the Competent Authority on 31.05.2021, and the same may be directed to be considered for the purposes of remittance of the retained amount claimed by the petitioner, which is due to be paid to him.
Though, this Court was apprehensive to entertain the writ petition on the ground of its maintainability, but the learned counsel for the petitioner submitted that an identical issue cropped up for consideration, though in relation to yet another retired employee of the Society, Karya Vikraya Sehkari Samiti, Sitarganj, Udham Singh Nagar, in Writ Petition (S/S) No.511 of 2021, Prithviraj Singh Vs. State of Uttarakhand & others", and that the coordinate Bench of this Court on the basis of the liberty sought for by the learned counsel for the petitioner, therein, had disposed of the writ petition directing the respondent No.3, i.e. Registrar Cooperative Societies, to decide the representation of the petitioner within a period of four weeks.
In that eventuality, and in view of the accommodation granted by the coordinate Bench of this Court by the judgment dated 08.04.2021, this writ petition too would stands disposed of with a direction to the respondent No.3, to consider and pass an appropriate order in accordance with law, on the representation of the petitioner dated 31.05.2021, and it is expected that the respondent No.3, would pass an appropriate order and decide the matter, as expeditiously as possible, but not later than six weeks' from the date of the production of the certified copy of this judgment.
