This First Appeal has been filed against the judgment and decree dated 03.12.2021, passed by the learned Civil Judge (Senior Division), District Nainital in Civil Suit No.50 of 2019, "Ravindra Kumar vs. Kamal Gupta and Another", whereby the plaint has been rejected under Order 7 Rule 11(d) of the Civil Procedure Code, 1908.

Heard Mr. P.C. Maulekhi, the learned counsel appearing for the appellant through video conferencing.

This First Appeal is admitted. The learned counsel appearing for the appellant requested for an interim relief.
