The present criminal appeal has been preferred by the appellant, who is a convict in jail, as a consequence of judgment of conviction dated 20.01.2021, which has been rendered in the Special Sessions Trial No. 33 of 2018 "State Vs. Raj Kumar".
There is 609 days of delay in filing the present criminal appeal.
Delay condonation application i.e. (IA 1 of 2022), under Section 5 of the Limitation Act, has been filed by the learned counsel for the appellant seeking condonation of delay.
The said application is not being seriously opposed by the learned Government Advocate.
Couple with the fact, the reasons given therein, since seems to be satisfactory. Hence, the delay of 609 days, which has chanced in filing the criminal appeal, would stand condoned.
The delay condonation application is allowed.
With the consent of the learned counsel for the parties, the appeal is heard on admission.
Admit the appeal.
Summon the lower court record. List this criminal appeal after receipt of the lower court record for consideration of the bail application.
Meanwhile, the learned Government Advocate may file objections to the bail application.
