The present special appeal is directed against the order dated 20.02.2018, passed by the learned Single Judge in WPSS No. 1683 of 2015 (Shyam Singh Adhikari Vs. State of Uttarakhand and Others). The learned Single Judge merely directed the appellant-Company to consider the case of the respondent/writ-petitioner, who claimed pay-scale of Rs.15600-39100/- from the date of his joining i.e. 28.02.2014, in the light of the judgment of this Court dated 01.03.2006 in WPSS No. 4181 of 2001, within a period of ten weeks from the date of the order.

Learned counsel for the respondent/writ-petitioner submits that the appellant has already considered the case of the respondent/writ-petitioner, and rejected the same on 10.10.2018. According to him, this appeal has, therefore, become infructuous.

Learned counsel for the appellant wishes to take instructions in the matter.
