The present Criminal Appeal has been filed by

the appellants against the judgment dated 08.07.2022,

passed by the Ist Additional District and Sessions Judge,

Haridwar in Sessions Trial No.4 of 2012, "State vs. Intezar

and two Others", whereby, the appellants have been

convicted for the offence punishable under Section 323 of

IPC and have been sentenced to undergo simple

imprisonment for a period of six months along with a fine

of Rs.500/-.

2. Heard Mr. Zakir Ali, the learned counsel and Mr.

Kishan Singh, the learned counsel for the appellants and

Mr. Siddhartha Bisht, the learned Brief Holder for the

State.

3. The Appeal is admitted.

4. Heard the learned counsel for the parties on the

Bail Application (IA No.1 of 2022).

5. The learned counsel appearing for the appellants

submitted that the appellants are on interim bail and

during the trial they were on bail. The learned counsel for

the appellants further submitted that the appellants

undertake to deposit the cost, as imposed by the learned

Trial Court, within ten days from today.

6. The learned counsel for the State has no

objection.

7. Considering the facts and circumstances of the

case, this Court is inclined to grant bail to the appellants,

namely, Intezar, Noor Ahmad and Sarfaraj, provided they

submit their personal bond and two reliable sureties, each

in the like amount to the satisfaction of the court

concerned.

8. List this case on 21.10.2022.
