Mr. Siddhartha Singh, Advocate for the petitioner.

This is husbands petition filed under Article 227 of the Constitution of India against order dated 26.03.2022, passed by Additional Judge, Family Court, Roorkee, whereby his application seeking impleadment of the person against whom charge of adultery is made, was rejected.

Mr. Siddhartha Singh, Advocate for the petitioner has placed reliance upon Allahabad High Court Hindu Marriage and Divorce Rules, 1956, particularly to Rule 6 thereof, wherein it is stated that the person against whom charge of adultery is made shall also be made a party to the divorce suit.

He has also placed reliance upon a judgment rendered by Division Bench of this Court in FA No. 16 of 2015.

In addition to normal mode of service, petitioner is permitted to serve the respondent through her counsel appearing before the learned Court below.
