Heard Mr. Bhupesh Kandpal, learned counsel for the petitioner, Mr. V.S. Rathore, learned AGA for the State and Ms. Pooja Tiwari, learned counsel for the respondent no.3.
On 02.03.2022, the learned counsel for the State was directed to inform this Court what action has been taken by the Station House Officer, Kotwali Ramnagar on the written information dated 21.11.2022, submitted by the petitioner. On 25.03.2022, the learned counsel for the State requested further time to get instructions. Today, the learned counsel for the State submitted that FIR was not registered.
The learned counsel for the petitioner submitted that the information of the informant discloses cognizable offence, therefore, in view of the judgment passed by the Hon'ble Supreme Court in Lalita Kumari vs. State of Uttar Pradesh, 2014 (2) SCC 1, the registering of the First Information Report is mandatory.
With the consent of the learned counsel for the State, the Station House Officer, Kotwali Ramnagar is directed to appear in-person before this Court on 13.04.2022.
