Petitioner has sought redressal of his grievances as raised in the present petition, based upon the judgment which was rendered by the Division Bench, as well as by this Court, whereby the relief was granted, considering the impact of the judgment rendered in Netram Sahu's case as reported in 2018 (5) SCC 430. The learned Standing Counsel has filed a counter affidavit, wherein he has made a reference to an order, which was rendered by the Hon'ble Apex Court as reported in 2020 SCC Online SC 141, Dhansai Sahu Vs. State of Chhattisgarh and others, where in view of two contradictory judgments, the Hon'ble Apex Court, the same has referred the matter to a larger Bench of the Hon'ble Apex Court, by an order dated 21.01.2020, as referred in SLP (Civil) No. 4970 of 2019.
Put up this matter in the second week of December, 2021 and the Registry of this Court is directed to collect the necessary information, as to how the reference made by the Hon'ble Apex Court to the larger Bench by an order dated 21.01.2020, whether it has been answered by the larger Bench of Hon'ble Apex Court so far or not.
