The petitioner is a senior citizen, who has filed the writ petition seeking an appropriate direction to the Assistant Collector Ist Class, Haldwani, District Nainital, to decide the suit, being Suit No.22/85 of 1993-94, Kishan Singh vs. State of Uttarakhand and others, which was preferred by the plaintiff/respondents for declaration of the rights in relation to the land in question by invoking the provision contained under Section 229-B of the Zamindari Abolition & Land Reforms Act.

The petitioner is a defendant he contends that for last 27 years, the matter is pending and the same has not yet been decided, though in spite of the fact that the petitioner happens to be a senior citizen.

Looking to the age of litigation, since it is a suit of 1993, which has not yet been decided, this writ petition is being disposed of with a direction to the Assistant Collector Ist Class, District Nainital to make all sincere efforts to decide the aforesaid suit, as expeditiously, as possible but not later than four months from the date of production of certified copy of this judgment.

It is made clear that no unnecessary adjournments would be granted until and unless it becomes unavoidable.

Subject to the above, the writ petition stands disposed of.
