Mr. Pramod Tiwari, learned B.H. for the State. This revision is directed against the judgment and order dated 26.02.2021 passed by the Additional Judge, Family Court, Dehradun in Crl. Case No.176 of 2017, Rashmi Chauhan Rana v. Sohan S. Rana.

It is submitted by the learned counsel that the revisionist had filed Original Suit No.1080 of 2017, Sohan Singh Rana v. Rashmi Chauhan, u/s 9 for the restitution of conjugal rights, wherein, an application u/s 24 of the Hindu Marriage Act was filed by the respondent; on that application, the concerned Court directed the revisionist to pay Rs.20,000/- as litigation expenses besides Rs.15,000/- as maintenance pendente lite; against the said order, the revisionist preferred Appeal from Order No.319 of 2019 before this Court; when the matter was listed before the Division Bench of this Court on 02.11.2019, both the learned counsel for the parties were present before the court and on their reaching to an agreement, the Division Bench ordered the fixed the amount of maintenance as Rs.10,000/- per month; since the revisionist is regularly paying the said amount, accordingly, he is not required to pay maintenance @Rs.15,000/- to the respondent, as has been awarded by the Court below.

Issue notice to the private respondents. Summon the LCR.

Steps to be taken within seven days. List the matter on 27.7.2021.

Meanwhile, the revisionist will continue to pay Rs.10,000/- per month to the respondent no.2 as per order dated 02.11.2019 passed by the Division Bench of this Court.

Stay application (IA 1/21) stands disposed of as such.
