                        JUDGMENT

Petitioners claim to be residents of Uttarakhand, as husband of petitioner no. 1 and father of petitioner nos. 2 to 5, namely, Mr. Umesh Chand was serving as Peon in the office of Assistant Regional Transport Officer, Haridwar since 10.06.1996 and now he has been promoted to the post of Administrative Officer in the office of Transport Commissioner at Dehradun.

2. By means of this writ petition, petitioner has sought the following relief:

"a) Issue a writ order or direction in the nature of Mandamus directing the respondents to consider and entertain the application of petitioners for permanent resident certificate and

same may be decided in accordance with law."

3. Learned counsel for the petitioners submits that Tehsildar is not entertaining the application made by the petitioners for Permanent Resident Certificate.

4. Learned Deputy Advocate General fairly submits that if petitioners make fresh application for Permanent Resident Certificate within two weeks from today, then the same may be entertained and considered by concerned Tehsildar and appropriate order thereupon shall be passed within six months thereafter.

5. Having regard to the facts & circumstances of the case, the writ petition is disposed of with liberty to petitioners to make fresh application for Permanent Resident Certificate within a period of two weeks from today. If such application is made within the stipulated period, the concerned Tehsildar shall consider the same and pass appropriate order, in accordance with law, as early as possible; but, not later than six months from the date of receipt of application alongwith certified copy of this order.
