Learned Counsel, Mr. D. C. Saha is present for the applicant-
petitioner.
Learned G.A., Mr. Kohinoor N. Bhattacharjee appears on
behalf of the State-respondents.
The applicant-petitioner has filed the writ petition before this
Court against the arbitrary action of the respondents by issuing
her subsequent transfer orders and also successive orders of
deputation and along with the writ petition this stay application is
filed for staying implementation of the order dated 28.01.2026
and Corrigendum Order dated 31.01.2026 issued by Chief Medical
Officer, Kailashahar, Unakoti Tripura.
Learned G.A., Mr. Kohinoor N. Bhattacharjee on instruction
appeared and submitted that due to the public policy considering
the shortage of staff the applicant-petitioner was given posting to
the concerned P.H.C. only for a period of 1 (one) month w.e.f.
29.01.2026 to 27.02.2026 but unfortunately the applicant-
petitioner has not yet joined to the said place of posting and
resulting which said P.H.C. is hereby suffering from shortage of
men power.
The main writ petition is pending for adjudication and from
the contents of the writ petition further it appears that, there were
multiple allegations against the respondent-authority by the
applicant-petitioner in respect of her frequent transfers. However,
considering the facts and circumstances of this case at this stage,
I am not inclined to pass any order of stay. As such, the stay
application filed by the applicant-petitioner is rejected.
However, the grievances raised by the applicant-petitioner in
the original writ petition would be taken up for consideration at
the time of disposal of the writ petition.
With this observation, this present I.A. stands disposed of.
