Heard learned counsel Mr. K Nath, appearing for the

petitioner and learned Addl. GA Mr. M Debbarma, appearing for

the respondents.

Learned Addl. GA Mr. Debbarma, referring to a letter

issued by the Standing Counsel of the State of Tripura to the

Secretary to the Government of Tripura, Higher Education

Department, submits that SLP (Civil) Diary No.41015/2024 was

filed in the Hon'ble Supreme Court against the impugned judgment

and order dated 06.04.2024 passed in WA No.59 of 2023 by this

court along with an application for interim relief seeking stay on

this judgment, but subsequently an application bearing No. MA

Diary No.35597/2025 for restoration and admission of the Special

Leave Petition was also filed before the Hon'ble Supreme Court

and the matter is currently being processed for registration and it

is being persuaded expeditiously. On that ground Mr. Debbarma,

learned Addl. GA has sought for an adjournment for four weeks.

Learned counsel Mr. Nath, submits that the State

government is not pursuing the matter diligently by before the

Hon'ble Supreme Court and therefore, it was once dismissed at the

registration stage as proper step was not taken by the State.

According to learned counsel Mr. Nath, the learned Writ

Court by the judgment dated 15.11.2021 directed the respondents

to issue necessary direction for regularization of the service of the

petitioner within a period of three months but they did not take

any step and when a contempt petition was filed, the State

preferred WA No. 59/2022, before the Division bench which was

also dismissed. Now a dilly dally tactics has been adopted by the

respondents and therefore the petitioner is being deprived of the

benefit of regularization and consequential monetary benefits.

Considered the submission. Four weeks time as sought

for is granted to the respondents.

However, learned Addl. GA Mr. Debbarma, after his

appearance for respondents No.1-3 have not submitted any

affidavit in opposition with reference to the show cause notice

issued earlier.

In view of above, the respondents will submit their

affidavit in opposition, if any, by the next date in addition to the

information about the SLP pending before the Hon'ble Supreme

Court.
