The present application has been filed under proviso to
Section 173 of the Motor Vehicles Act, 1988, seeking condonation of 92
day in presenting the connected appeal challenging the impugned
Judgment and Award dated 09.10.2023, passed by the learned Member,
Motor Accident Claims Tribunal, North Tripura, Dharmanagar, in T.S.
(MAC) No. 45 of 2019.
Mr. Sankar Lodh, learned counsel appearing for the applicant
submits before this Court that, as per the order passed by this Court, he
has taken steps to serve notice upon respondent No. 3 through paper
publication, and the proof of the same has been placed on record.
Accordingly, the learned counsel prays for condonation of the delay.
Heard both sides and perused the records.
For the reasons indicated in the accompanying affidavit filed
in support of the petition, the present condonation application stands
allowed, and the delay stands condoned.
