Order 31/07/2025 This appeal is preferred challenging the judgment and

order of conviction and sentence dated 05.07.2025 and

07.07.2025 delivered by Learned Special Judge, Dhalai District,

Ambassa in connection with Special (POCSO) Case No.05 of 2023

wherein the appellant was convicted under Section 363 of IPC

read with Section 34 of IPC. By the said judgment and order of

conviction and sentence Learned Trial Court found the present

appellant to be guilty and sentenced him to suffer RI for one year

for the offence committed punishable under Section 363 of IPC

and also to pay a fine of Rs.5,000/- in default to suffer R.I. for two

months and challenging that judgment this appeal is preferred.

Heard Learned Counsel Ms. Ayesha Saha Hirawat appearing

for the applicant and also heard Learned Addl. P.P. Mr. R. Saha

appearing for the State-respondent.

Considered.

Considering the nature and gravity of the offence and the

punishment so imposed the sentence delivered by the Learned

Trial Court be suspended till disposal of the appeal subject to

execution of bond of Rs.25,000/- (twenty five thousand) with one

surety of the like amount to the satisfaction of Learned Trial Court

below.

With this observation, this IA stands disposed of.

A copy of this order be furnished to Learned Counsel

appearing for the applicant and also a copy of this order be

communicated to Learned Trial Court for information and

necessary action.
