Order 28/07/2025 The applicant-appellant namely Iresh Nath has preferred

this appeal under Section 374 of Cr.P.C. challenging the judgment

and order of conviction and sentence dated 17.06.2025 delivered

by Learned Sessions Judge, North Tripura, Dharmanagar in

connection with Case No.ST (Type-1) 37 of 2021. By the said

judgment and order of conviction and sentence Learned Trial

Court found the applicant to be guilty for the commission of

offence punishable under Section 326 and 324 of IPC and

accordingly sentenced the convict to suffer imprisonment for three

years along with fine of Rs.10,000/- along with Section 326 of IPC

in default to suffer imprisonment for further period of three years

and further sentenced to suffer R.I. for two years under Section

324 of IPC and to pay a fine of Rs.5,000/- under Section 324 of

IPC in default to suffer further imprisonment for a period of one

month. It was ordered that both the sentences shall run

concurrently.

Heard Learned Counsel Mr. S. Das for the applicant and also

heard Mr. R. Datta, Learned P.P. appearing on behalf of the State-

respondent.

Considering the nature of acquisition and sentence imposed,

the execution of sentence issued against the applicant be

suspended till disposal of the appeal of his execution of bond of

Rs.50,000/- (fifty thousand) with one surety of like amount to the

satisfaction of Learned Trial Court below.

With this observation, this IA stands disposed of.

A copy of this order be communicated to Learned Court

below and also a copy of this order be supplied to Learned Counsel

appearing for the applicant for information and compliance.
