Heard learned counsel for the respective parties.
This application has been filed under Section 5 of the Limitation Act, for
condoning the delay for a period of 63 days in preferring the Appeal against the
impugned judgment and award dated 27.06.2022 passed in Misc. (L.A) 25 of 2015 by
the learned Land Acquisition Judge, Sepahijala, Tripura, Bishalgarh.
It is seen from the office note dated 03.06.2025 that notice upon
respondent No.1 has been carried out by way of Dasti service, but when the case is
called, there is no representation from the respondent No.1 despite receiving of
notice. Mr. A. K. Pal learned counsel appears on behalf of respondent No.2.
For the reason stated in the accompanying affidavit and the averments
made out before this Court during the course of arguments, delay caused in
preferring the appeal is condoned and the same is ordered.
In view of the same, this instant interlocutory application is allowed and
thus, the same is disposed of.
