Heard Ld. Sr. Counsel Mr. Pijush Kanti Biswas assisted by
Mr. Harekrishna Bhowmik, Advocate and other Ld. Counsel for
the petitioner.
Ld. Sr. Counsel Mr. Biswas submits that in connection with
East Agartala P.S. Case No.61 of 2025 registered under Section
61/ 109/ 148/ 118(2)/3(5) of BNS, 2023 and under added
Section 192 and 196 of the BNS, 2023 the father and brother of
the petitioner namely Najrul Miah and Khairul Islam submitted
Bail Application No.104 of 2025 which was heard and disposed of
by the Ld. Addl. District & Sessions Judge(Court No.2), West
Tripura, Agartala and thereafter the present petitioner in
connection with said East Agartala P.S. Case No.61 of 2025
submitted a petition under Section 482 of BNSS, 2023 which was
transferred by Ld. Sessions Judge, West Tripura to the Court of
Ld. Addl. Sessions Judge (Court No.4), West Tripura, Agartala for
decision, though as per the ratio of the judgment passed by the
Hon'ble Supreme Court in Shekhar Prasad Mahato @ Shekhar
Kushwaha vs. Registrar General, Jharkhand High Court &
Anr.[Writ Petition (Crl)No.55 of 2025] both the bail
applications are required to be heard by the same Court. Ld. Sr.
Counsel Mr. Biswas also submits that the subsequent bail
application no.112 of 2025 submitted by the present petitioner is
now pending in the Court Ld. Addl. Sessions Judge (Court No.4),
West Tripura, Agartala and said Ld. Court had allowed the
petitioner time to approach this Court for a direction in this
regard for hearing of the said bail petition by Court of Ld. Addl.
Sessions Judge(Court No.2), West Tripura, Agartala. Ld. Sr.
Counsel Mr. Biswas also refers to one screen shot taken from the
web portal of West Tripura Judiciary which shows that when said
bail application was submitted on 15.07.2025, one entry was
made that it was being transferred to the Court of Addl. Sessions
Judge (Court No.2) but again another entry was made later on
showing that it was transferred to the Court of Ld. Addl. Sessions
Judge (Court No.4).
In view of above facts, Ld. Public Prosecutor submits that
before passing any effective order on this writ petition, a report
may be called for from the Court of Ld. Sessions Judge as to why
said case was transferred to the Court of Addl. Sessions
Judge(Court No.4).
Considered the submission.
Ld. Sessions Judge, West Tripura is asked to submit a
report in this regard by 18.08.2025 after communication of this
order.
List the matter on 18.08.2025.
Registry is to communicate the order to Ld. Sessions Judge.
