Heard Mr. A. Acharjee, learned counsel appearing for the
applicant.
By this petition, prayer has been made to condone delay of
865 days in preferring the appeal.
Mr. Acharjee, learned counsel submits that the applicant hails
from a very poor family and in such a financial constraint, there
was none to take an initiative to prefer appeal against the
impugned judgment and ultimately, the delay was occasioned. Mr.
Acharjee, learned counsel also submits that that for a long period
the accused is in jail and if the appeal is not admitted, he will
suffer irreparable loss.
Considering the fact that this is a jail appeal and the
applicant is in custody, learned PP did not oppose the prayer and
urges for taking the main appeal for hearing on merit.
Considered the submissions.
The Court is satisfied. The delay as sought for is condoned.
The interlocutory application is accordingly disposed of.
