The appellant-applicant has preferred this appeal challenging

the judgment and award dated 13.07.2021 passed by Learned

Motor Accident Claims Tribunal, Agartala, West Tripura, Tribunal

No.2 in connection with TS(MAC) No.164 of 2017 and along with

memo of appeal another application under Second Proviso to

Section 173 of MV Act, 1988 is filed for condoning the delay of

1038(one thousand and thirty eight) days in preferring the

appeal.

Heard Learned counsel for the appellant-applicant.

Considered.

Issue notice upon the respondents in the IA and also in the

main appeal.

The appellant-applicant may take steps for service of notice

by normal process and also by registered A/D post within seven

days and file proof of service.
