Order
This present application has been filed for
reviewing the Order dated 06.11.2024 passed in Mat. App.
No. 03 of 2024.
2. The brief facts of this case are that the respondent
preferred an appeal being MAT Appeal No. 04 of 2024 against
the Judgment dated 20.09.2023 passed in TS(Div) No. 65 of
2020 by the learned Family Court, Agartala, West Tripura. The
case was taken up by this Court on 06.11.2024, whereby this
Hon'ble Court directed both parties to live together and lead
their conjugal life. It was further directed that the petitioner
should take care of the respondent with due respect and
hospitality. A direction was also issued for immediate
compliance. Subsequent to the said direction, the petitioner-
husband herein attempted to comply with the said order and
to lead a conjugal life. However, the respondent-wife allegedly
assaulted the petitioner and created disturbances and
nuisances at the petitioner's workplace, making his life
miserable. Due to such situation, the petitioner-husband has
filed this petition for a review of the order dated 06.11.2024
passed by this Court.
3. Heard Mr. D. Bhattacharjee, learned Senior
Counsel, assisted by Mr. S. Saha, learned counsel appearing
for the petitioner. None appears for the respondent.
4. Vide order dated 06.11.2024, the main case was
listed on 10.12.2024, and the same was only an interim
order. There is no reason for the petitioner herein to file this
present review application. The affidavit herein does not
contain anything substantial but only allegations, and for such
allegations, the petitioner-husband could have filed a
complaint. As the order dated 06.11.2024 is only an interim
order and the case has been fixed for 10.12.2024, the
petitioner could have waited and submitted his grievance on
the said date.
5. As such, in view of the above observation, this
Court does not find any reason to interfere with the order
dated 06.11.2024, and the present review petition stands
dismissed. As a sequel, miscellaneous application(s), if any,
also stand closed.
