24/07/2024 Learned Counsel Mr. S. Datta is present for the appellant-

applicant.

Notice is served upon the respondents No.1 and 2, but

nobody appeared on behalf of the said respondents.

The appellant-applicant has preferred this appeal

challenging the judgment and award dated 28.04.2023 passed

by Learned Member Motor Accident Claims Tribunal, Sepahijala

District, Sonamura in connection with Case No.T.S.(MAC) No.11

of 2019 and along with the memo of appeal another application

under Section 5 of the Limitation Act is filed for condoning delay

of 273 (two hundred and seventy three) days in preferring the

appeal.

Heard Learned counsel for the appellant-applicant.

Learned counsel for the appellant-applicant at this stage

drawn the attention of this court referring the grounds

mentioned in para Nos.5, 6, 7 and 8 of this petition.

Considered.

This court is satisfied with the grounds as mentioned in

the petition and hence the petition filed for condoning the delay

is hereby allowed and the delay is condoned.

In view of the above, IA stands disposed of.
