Heard Mr. D Bhattacharya, learned Sr. counsel assisted

by Mr. S Das, learned counsel appearing for the applicants and Mr.

K Deb, learned counsel appearing for the sole-respondent.

Learned counsel for the applicants submits that by the

impugned judgment dated 22.08.2023 passed by the learned Addl.

District Judge, Dhalai Judicial District, Ambassa, direction has been

given to the parties, more particularly the applicants, to execute a

fresh sale deed in favour of the respondent and to get the same

registered within three months from the judgment. Further

direction was given to the applicants, not to disturb the peaceful

possession of the respondent though no cross suit or counter claim

was submitted by the respondent-defendant against the claim of

the plaintiff-applicants in this regard.

Learned counsel of the applicants also submits that if

the operation of the impugned judgment is not stayed, the

applicants will in hardship as direction has been given to comply

with the same in a time bound manner.

Learned counsel Mr. Deb, submits that they have not

filed any execution petition for execution of the direction of the

First Appellate Court, and therefore, he has no objection if stay is

granted.

Considered the submissions and also perused the

records. The operation of the impugned judgment dated

22.08.2023 passed in T.A. No. 01 of 2023 by the learned Addl.

District Judge, Dhalai, Ambassa and related decree thereof shall

remain stayed till disposal of the connected appeal.

Registry shall communicate the order to the learned

First Appellate Court and also to the learned Trial Court.

IA is accordingly disposed of.
