                                Order
13/10/2023

Heard Mr. K. Nath, learned counsel appearing for the petitioner. This is a contempt petition filed by the petitioner under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India for alleged willful disobedience of the court's Judgment and Order dated 27.06.2023 in WP(C) No. 1001 of 2022 passed by this Court.

Mr. Nath, learned counsel for the petitioner has drawn my attention to para 10 of the judgment and order dated 27.06.2023 where this Court had passed the following directions:-

" 10. Accordingly, I direct the respondents to grant regular pay scale to the petitioner with effect from the date he joined as Graduate Teacher(w.e.f. 23.07.2021) under the respondents on fixed pay basis since he completed more than 5(five) years' of service as Constable under the previous employer, that is, Police Department, Govt. of Tripura on regular pay scale wherefrom he only technically resigned. The respondents are further directed to release arrears of pay and regularize all other consequential service benefits to the petitioner within a period of 2(two) months from the date of receipt of a copy of this order."

Issue notice calling upon the respondent-contemnors to show cause as to why a proceeding under Section 12 of the Contempt of Courts Act shall not be drawn against them, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper.

Notice is made returnable within 6 (six) weeks.

The petitioner shall take steps for service of notice upon the respondent-contemnors within 7 (seven) days by registered post with AD.

List the matter on 24.11.2023.
