Heard Ms. A. Debbarma, learned counsel appearing for the
petitioner. Also heard Ms. S. Chakraborty, learned counsel appearing for
the respondents-State and Mr. B. Majumder, learned CGC appearing for
the respondent-Union of India.
Briefly stated, the petitioner was an Anganwadi Worker under the
respondents. On attaining the age of 60 years, the petitioner was sent on
superannuation.
The Government of Tripura has taken a policy decision that the
superannuation age of the Anganwadi Workers would be 65 years subject
to the decision of the case pending before the Hon'ble Supreme Court.
This Court in various judgments held that the services of the
Anganwadi Workers shall not be discontinued till he/she attains the age
of 65 years subject to the decision of the case pending before the
Supreme Court.
In view of this, I direct the respondents to re-instate the petitioner as
she was there before her superannuation i.e. as Anganwadi Helper within
a period of 3(three) weeks from today.
With the aforesaid directions, the instant writ petition stands allowed
and disposed of.
