Mr. Samarjit Bhattacharjee, learned counsel appearing for the
appellant-wife, submits that the case has been taken up for hearing for the
first time. The paper books have to be obtained. Therefore, the matter may
be adjourned.
Appellant is aggrieved by the judgment and decree of judicial
separation granted by learned Judge, Family Court, Khowai District, Tripura
vide impugned judgment and decree dated 16.06.2022 whereby the suit No.
T.S.(J.S) 01 of 2018 preferred by the respondent-husband for judicial
separation on grounds of adultery and cruelty has been allowed on the
ground of cruelty alone. No attempts for an amicable settlement have been
made at this appellate stage.
We, therefore, deem it proper to ask the parties to appear on the
next date so that an effort for amicable settlement of their dispute may be
made before adjudication on merits. If the parties agree, they can also be
referred for mediation at this stage in the spirit of the Family Courts Act,
1984.
Let the case be listed on 15.05.2023.
Meanwhile, learned counsel for the parties may obtain the paper
books also.
