Heard Mr. Raju Datta, learned counsel appearing for the petitioner. Also heard Mr. R. Saha, learned counsel appearing for the respondents-State and Mr. B. Majumder, learned Dy. S.G appearing for the respondents-Union of India.
The fact of the above case, in brief, is that the petitioner was appointed as Anganwadi Worker. She has challenged her retirement benefit after attaining the age of 60 years.
In view of the judgment passed by this Court holding that fixing the retirement age of the Anganwadi Workers at 65 years, the respondents-State issued a memorandum dated 17.10.2022, wherein it has been decided that all the Anganwadi Workers and Anganwadi Helpers would not retire after attaining the age of 60 years and they may continue till 65 years subject to the decision of the S.L.P now pending before the Hon'ble Supreme Court of India.
In view of the above, the instant writ petition stands allowed and disposed. The service of the petitioner will be regulated as per memorandum dated 17.10.2022.
