HON'BLE MR. JUSTICE ARINDAM LODH Order 07/11/2022 This is an application filed by the petitioner under Order XLVII Rule (1) read with Section 151 CPC seeking review of the judgment dated 01.02.2021 passed in case no. CRP 08 of 2021. Heard Mr. SM Chakraborty, learned senior counsel assisted by Mr. S. Saha, learned counsel appearing for the petitioner. Also heard Mr. Raju Datta, learned counsel appearing for the claimant-respondents. Paper publication was made for appearance of the claimant- respondents. Despite issuance of notice, the claimant-respondents did not turn up. Accordingly, the matter is taken up for hearing. I have perused the impugned judgment dated 01.02.2021 passed by this court in CRP 08 of 2021.
I have reconsidered the issues raised in this application and it is found that the question of limitation is required for further consideration. Accordingly, the matter is remitted to the court of learned Additional District Judge, Sepahijala, Bishalgarh. The parties are at liberty to raise all the questions before the learned Additional District Judge, Sepahijala. Both the parties are also at liberty to submit their written statements.
The learned Additional District Judge, Sepahijala shall issue notices upon the parties concerned.
With the above directions, the instant writ petition stands disposed of.
