ORDER
04.05.2022 The accused was acquitted by the court of Judicial
Magistrate of the First class from the charge of offence
punishable under Section 138 NI Act, by the judgment and order
dated 19/11/2018 passed in CR (NI) 30 of 2017.
The said order of acquittal was challenged by the
complainant petitioner in appeal in the court of the Sessions Judge
Gomati Judicial District at Udaipur. Learned Addl. Sessions Judge
by his judgment and order dated 11/03/2022 passed in Crl. Appeal
No. 39(4) of 2018 dismissed the appeal.
Aggrieved petitioner has therefore, approached this
court by filing the present criminal revision petition.
Heard Mr.A.Acharjee, learned Advocate appearing
for the petitioner.
Heard Mr.S.Debnath, learned Addl.PP for the state
respondent.
Perused the record.
The Criminal Revision Petition stands admitted.
Notice for Respondent No.01 is waived by learned
Addl.P.P. It is submitted by Mr. Acharjee, learned counsel that
copy of the petition along with accompanying documents has
already been served on learned Addl. PP by the petitioner.
The petitioner is to take steps for service of notice on
Respondent No.2 within a period of 4 days.
