This is an application filed under Section-5 of the Limitation Act for condoning the delay of 31 days.
According to the applicant, in view of the exemption granted by the Hon'ble Apex Court, there is no delay and even if there is any delay, it is only few days which can be condoned by this Court by exercising its reasonable discretion. The date of the judgment is 11.11.2019 and the decree has been prepared in February, 2020 and the certified copy has been furnished on 12.06.2020 and from 15th March, 2020, in view of the pandemic, the order of the Hon'ble Apex Court extends the benefit.
In view of the above submission, this Court feels that an opportunity needs to be given by condoning the delay of 31 days.
Accordingly, the present application for condoning the delay of 31 days stands allowed.
Meanwhile, learned counsel for the applicant is at liberty to take out notice upon the respondent by way of registered post with A/D and file proof of service indicating the next date of hearing. Registry shall also take out the notice upon the respondents and file proof of service.
Let the matter be listed on 04.04.2022.
