Order 27/06/2022 It is the case of the petitioner that his service has been
terminated without giving proper opportunity despite the
petitioner was inclined to join the service. But he was helpless
in view of the COVID-19 situation and by the time he could
resume to his services he was placed with the termination
order.
The impugned order has been passed in Jammu &
Kashmir. The petitioner preferred an appeal and the appeal was
confirmed by the concerned authority in Jammu and Kashmir.
Learned ASGI appearing for the respondents submits
before this court that this writ petition is not maintainable on
the ground of territorial jurisdiction as the impugned order has
been passed in Jammu & Kashmir and the petitioner must
approach the competent court of the Jammu & Kashmir.
The counsel appearing for the petitioner submits that
since the petitioner is residing in the state of Tripura and the
correspondence of the impugned proceedings have been served
upon him through the process in the State of Tripura, the cause
of action arose in the State of Tripura and therefore, the writ
petition is made in the High Court of Tripura as it has the
territorial jurisdiction.
However, the counsel for the petitioner seeks
accommodation for placing the relevant judgments of the apex
court in support of his contention.
