It is submitted at the Bar by the learned counsel for the original writ
petitioner (respondent herein) that the present writ appeal is based on an earlier
judgment passed by the learned Single Judge of this Court in WP(C) 1741 of
2017. It appears that the State of Tripura have also challenged the said
judgment before the Hon'ble Supreme Court in Special Leave to Appeal
(c)No(s).8768/2022 and the same has been admitted and pending adjudication.
It would be pertinent to note herein that while entertaining the present
writ appeal, this Court has placed reliance upon the interim directions issued by
the Hon'ble Supreme Court in the aforesaid Special Leave to Appeal.
Since the issues raised in the present writ appeal are also subject matter
of challenge before the Hon'ble Apex Court in Civil Appeal No.9198-9199 of
2018, both parties to the present appeal are at liberty to move the Hon'ble
Supreme Court to seek transfer of the present appeal, if they are so advised.
