It is brought to our notice by Mr. Debalay Bhattacharjee,

learned Government Advocate, that final judgment and order dated

25.07.2018 in W.A. No.32 of 2016 passed by the High Court of Tripura is

the subject matter of challenge before the Hon'ble Supreme Court in Special

Leave to Appeal (C) No.8567/2019. The said judgment forms the basis for

passing of the impugned judgment by the Hon'ble Single Judge. It is stated

that in the main case the Hon'ble Supreme Court by order dated 17.09.2021

had admitted the matter and directed the State not to take out any

proceedings seeking recovery of the amount from the concerned employees

to whom arrears were made over by the State. In view of the aforesaid

situation, learned Government Advocate prays that this matter may be

suitably adjourned awaiting final outcome of the Special Leave to Appeal

pending before the Hon'ble Supreme Court.

Matter stands adjourned to 08.11.2022.

Tag this matter along with W.A. No.165 of 2021, W.A. No.167

of 2021 and W.A. No.168 of 2021.

In the meantime, liberty is granted to counsel of both sides to

seek early listing of the matter if the matter gets disposed of by the Hon'ble

Supreme Court.
