Let the matter be listed on 23.02.2022 at 2.00 p.m.
Mr. D. Bhattacharya, learned senior counsel assisted by
Mr. P. Saha, learned counsel has submitted that it is expected
that in the early part of the session tomorrow i.e. 23.02.2022,
the apex court would pass the order for staying the operation of
the judgment which has been alleged to have been violated by
the respondents.
Mr. Bhattacharya, learned senior counsel has submitted
that Mr. V.S. Yadav, the Director General of Police, the
respondent No.2 and Mr. Routhlunga Darlong, the respondent
No.3 cannot play any role so far the appointment is concerned.
If that is so, those respondents may file a simple application for
deletion of their name as for the first time, it has been pointed
out to the court by Mr. V.S. Yadav himself who has appeared
before this court in terms of the order dated 18.02.2022. So far
the personal appearance is concerned it will be only limited to
the respondent No.1, Shri Saradindu Choudhury who will
appear tomorrow. Personal appearance for the remaining
respondent is dispensed with subject to the order for deletion of
their name, as contemplated.
