Issue post admission notice to the respondents making the same
returnable within 6(six) weeks.
Mr. Bidyut Majumder, Asstt. S.G. is present representing the
respondent Nos. 57 & 58, Union of India.
Extra copies of the memo of appeal be handed over to him.
The execution and operation of the impugned Judgment &
Order dated 23.03.2022 passed by Hon'ble the Single Bench of this Court is
hereby stayed.
In the meanwhile we also permit the State and/or local
authorities to carry out regular process of selection for appointment of
teachers in terms of regulation 10(b), (i) & (ii) of the guidelines for
conducting Teacher Eligibility Test (TET) under the Right of Children to
Free and Compulsory Education Act (RTE), 2009 subject outcome of the
appeal.
It is also clarified that if there is any recruitment under the Rule
10(a), the same shall be governed by test conducted by the Central
Government.
List this matter on 13.09.2022.
