07/09/2021 Heard Mr. P. K. Pal, learned counsel appearing for the
petitioner.
This is a petition filed under Section 12 of the Contempt of
Courts Act, 1971 read with Article 215 of the Constitution of
India alleging wilful disobedience to the direction contained in
the judgment and order dated 29.05.2020 passed in W.P.(C)
No.990 of 2018 which has been affirmed by the judgment dated
29.06.2021 delivered in WA No.464 of 2020 [Annexure-2 to this
petition].
From perusal of the records, as placed along with this
petition, a prima facie case surfaces.
Issue notice calling upon the respondents to show cause
as to why a contempt proceeding under Section 12 of the
Contempt of Courts Act, 1971 read with Article 215 of the
Constitution of India should not be drawn up for willful
disobedience shown to the direction contained in the judgment
and order dated 29.05.2020 passed in W.P.(C) No.990 of 2018
which has been affirmed by the judgment dated 29.06.2021
delivered in WA No.464 of 2020 as prayed for; and/or any other
order(s) should not be passed as to this Court may deem fit and
proper in the circumstances of the case.
Notice is made returnable on 08.10.2021.
Steps for service of notice on the respondents shall be
taken by the petitioner as per rule by registered post with A.D.
within 3(three) days from today.
