Order 03/09/2021 Heard Mr. T.D. Majumder, learned senior counsel assisted by Ms. K.

Debbarma, learned counsel appearing for the applicants.

This is an application under Order 41 Rule 5 of the CPC for staying the

judgment and award dated 11.02.2021 delivered in Misc.(L.A.)135 of 2014 passed by the

Land Acquisition Judge, West Tripura, Agartala, Court No.2 which has been challenged in

L.A.APP.44 of 2021. The said appeal has been admitted today.

Mr. T.D. Majumder, learned senior counsel appearing for the applicants has

submitted that unless the operation of the award is stayed by this court despite filing of

this appeal, the impugned award may be put for satisfaction by execution. In such

circumstances, he has pressed for staying the operation of the said award.

Since, the appeal has been admitted to be heard on merit, the judgment

and award dated 11.02.2021 as aforestated, shall remain suspended pending disposal of

the appeal being L.A.APP.44 of 2021 subject to payment of 50% of the total award

within a period of two months from today.

The respondents are given liberty to approach this court for early hearing of

the appeal, if it is found that the paper book is ready after receipt of the LCRs from the

court below.

Hence, this application stands disposed of.
