Heard Mr. S. Bhattacharjee, learned counsel appearing for

the applicant in presence of Ms. P. Dhar, learned counsel

appearing for the respondent No.1 and Mr. P. Gautam, learned

counsel appearing for the respondent No.2.

This is an application by the referring-claimant, who was

the respondent in the appeal being 133 of 2019 which was

preferred by the respondent No.1 herein from the judgment and

award dated 30.04.2019 delivered in Misc. (LA) 24 of 2012 by

the LA Judge, Sepahijala District, Sonamura. The said appeal has

been dismissed by the judgment and order dated 04.02.2021 by

this court. The respondent No.1 has deposited a sum of

Rs.04,71,050/- on 13.01.2021 and another sum of

Rs.05,18,883/- on 12.08.2021 in the Registry towards dis-

charging their liabilities. The entire amount being 9,89,933/- is

now to be paid by the Registry to the applicant with interest.

Now, by means of this application, the referring-claimant

seeks leave of this court for withdrawing the total amount. There

is no impediment in causing disbursement of the said amount in

favour of the referring-claimant-applicant and accordingly, it is

directed that the said amount with interest, if any, shall be paid

to the applicant forthwith.

In terms thereof, this application stands allowed and

disposed of.
