Mr. Debalay Bhattacharjee, learned Government Advocate,

brought to our notice an interim order passed in petition for leave to appeal

No.8567 of 2019 arising out of final judgment and order dated 25.07.2019 in

Writ Appeal No.32 of 2016 passed by the High Court of Tripura at Agartala

wherein the Hon'ble Court by order dated 17.09.2021 has directed as follows:

"Pending further consideration the effect and operation of the

order under challenge shall remain stayed."

It is further brought to our notice that the present application for

contempt arises out of directions issued by this Court in W.A. No.455 of 2020

by which appeal by the State of Tripura came to be dismissed by order dated

18.01.2021 following the directions passed earlier in case of Bipul Rn. Dey

and others arising out of W.A. No.191 of 2020 which appeal was dismissed

by the Division Bench of this Court by judgment dated 12.01.2021. Learned

Government Advocate wants to file an affidavit indicating further steps in the

matter as to whether the State have moved an SLP before the Hon'ble

Supreme Court in W.A. No.191 of 2020 as well as whether in the present

batch of cases i.e. W.A. No.455, 456 and 457 of 2020. The learned

Government Advocate submits that the issues raised in the present order from

which the contempt has arisen is similar to the issues pending before the

Hon'ble Supreme Court and he seeks further short adjournment to file a

necessary affidavit to that effect. Two weeks' time to file an affidavit is

granted. Copies be served on the counsel for the contempt petitioner.
