HON'BLE MR. JUSTICE ARINDAM LODH Order 12/07/2021 Heard Mr. A. Bhowmik, learned counsel appearing for the petitioner. Also heard Mr. P. Saha, learned counsel appearing for the State respondents.
Issue Notice calling upon the respondents to show cause as to why a Rule shall not be issued, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper. Notice is made returnable on 23.08.2021. Since, Mr. P. Saha, learned counsel on instruction of Mr. D. Bhattacharjee, learned GA appears and accepts notice on behalf of State- respondents, no formal notice is called for. Mr. Bhowmik, learned counsel has submitted that the instant writ petition is squarely covered by a judgment of this court passed in WP(C) 703 of 2019 dated 19.03.2021, titled as Sri Kamanasish Das and others vs. State of Tripura and others (Annexure 28 to the writ petition). Learned GA is requested to peruse the judgment and inform this court as to whether the petitioners are entitled to get the benefits or not. It is made clear that if the matter does not appear to be similar and identical to the question decided in the above writ petition, in that case, the State-respondents shall submit their counter affidavit within the returnable date.
