JUDGMENT:
(Per Hon'ble Justice Moushumi Bhattacharya)
The parties are present in Court.
2. Learned counsel appearing for the respondent submits that the
parties have entered into Memorandum of Understanding ('MOU')
dated 15.09.2025 by which the parties have settled their disputes.
The original MOU is placed before the Court.
3. We find that the appellant as well as the respondent have
signed the MOU. The MOU is also witnessed by the brothers of the
appellant and the respondent. The signature of counsel for the
respondent is also on the MOU.
4. We do not find any necessity of affixation of the signature of the
appellant's counsel, on the MOU since the appellant is present in
Court and submits that the appellant is a party to the MOU. The
parties have been identified by counsel appearing for the respondent.
5. Since both parties are present in Court and the MOU dated
15.09.2025 is placed before us, nothing further remains of the
dispute.
6. FCA.No.183 of 2024, along with all connected applications, is
disposed of in terms of the above. There shall be no order as to costs.
7. We note that on 04.09.2025, counsel had sought for securing of
the CCTV footage and call data records from 24.08.2025.
8. W.P.No.26295 of 2025, along with all connected applications, is
accordingly dismissed as withdrawn. Interim orders, if any, shall
stand vacated. There shall be no order as to costs.
